Ace Drive Pte Ltd, operating under the Hertz Singapore Brand (referred to herein as “Hertz Singapore”, “we”, “us”, “our” or “the Company”), provides Vehicle rental services to our customers (“Renter”, “you”, “your”). Ace Drive Pte Ltd is a registered company in Singapore (Reg No. 201004348K) with its registered office at 50 Ubi Avenue 3, #01-02 Frontier Building, Singapore 408866.

THE TERMS & CONDITIONS ('TERMS') HEREIN GOVERN YOUR USE OF OUR SERVICES AND CONTAIN CONDITIONS, LIMITATIONS, AND EXCLUSIONS THAT MIGHT APPLY TO YOU. PLEASE READ THEM CAREFULLY.

01Definitions

  • • Account:means the digital or physical record registered to a Renter to access our Services.
  • • Additional Fees:means any fees incurred regarding the Vehicle including but not limited to fuel shortages, tolls (ERP), excess mileage, traffic violations, parking fines, court costs, recovery charges, damages (dents, scratches), professional detailing fees (for smoking/pests), and any other loss resulting from a breach of these Terms.
  • • Agreement:means the Rental Agreement signed by You and the Company, incorporating these Terms.
  • • Authorized Driver:means i) You (the Renter) and/or ii) a licensed driver who has signed and been accepted as an “Additional Driver” on the Rental Agreement.
  • • Booking/Reservation:means a confirmed request to rent a Vehicle.
  • • Company:Refers to Ace Drive Pte Ltd.
  • • Excess/Deductible:The amount the Renter is liable to pay in the event of an accident or damage before insurance coverage applies.
  • • Services:means the rental of Vehicles and associated services provided by the Company.
  • • Vehicle:refers to the car mentioned in the Rental Agreement, including tires, tools, accessories, documents, and equipment.

02Your Acceptance of These Terms

These Terms apply to all Services provided by Hertz Singapore. By making the booking online and signing the Rental Agreement or collecting a Vehicle, you agree to comply with and be legally bound by these Terms.

You acknowledge that the Agreement is subject to the consumer protection laws applicable in Singapore. If you allow another person to drive the Vehicle (Authorized Driver), you agree that you remain fully responsible for the Booking and the use of the Vehicle.

03Modifications

We reserve the right to amend these Terms from time to time. We are taking steps to improve our environmental footprint and are replacing paper versions with electronic versions. Your continued use of our Services or Vehicles constitutes acceptance of any such changes.

04Registration and Eligibility

To rent a Vehicle, you must provide complete and accurate personal information, including a valid driving license, passport/ID, and credit card details.

Verification: We have the right to undertake screenings to verify your identity, driving history, and creditworthiness. We reserve the right to refuse a rental if you do not meet our internal assessment requirements.

05Driver Qualifications

You warrant that the Vehicle will only be driven by Authorized Drivers who:

  • Hold a valid Singapore Class 3 license or a valid international driving license (with English translation if required).
  • Meet the age and experience requirements stipulated by the Company (typically between 23 and 65 years of age with at least 2 years of driving experience, unless approved in writing).
  • Have provided copies of their license and NRIC/Passport/Visa to the Company.

06Using the Services & Vehicle Collection

Delivery/Collection: The Vehicle is delivered to you in good working condition. You must inspect the condition of the Vehicle before the start of the rental and agree on any existing defects in a vehicle condition report.

Availability: While we endeavor to provide the specific Vehicle model booked, we reserve the right to substitute a Vehicle of a similar or higher category in the event of unavailability, mechanical fault, or safety issues.

Extensions: The rental period may only be extended with prior approval from the Company and payment of applicable extension charges. Unapproved extensions will result in penalties and potential repossession.

07Payments and Deposits

Payments: You appoint the Company to collect all payments relating to the rental. Rental charges, deposits, and estimated additional fees are payable on demand and time is of the essence.

Security Deposit:

  • A security deposit is required before the start of rental.
  • The deposit is refundable within 7 - 14 working days from the return date, subject to deductions for traffic violations, summons, unpaid penalties, mileage excess, fuel shortages, and damages.
  • The deposit amount varies based on the vehicle type and is subject to change.

Late Payment: Any overdue payment will incur interest at 2% per month. If payment is delayed, we reserve the right to repossess the Vehicle and blacklist your account.

08Your Obligations

You agree to:

  • • Vehicle Condition:Return the Vehicle in the same condition as received.
  • • Temperature Gauge:Ensure the temperature gauge remains below the red line. If it reaches the red line, stop the engine immediately and call our 24hr breakdown line.
  • • Security:Always lock the Vehicle when not in use. You are liable for the replacement of lost keys.
  • • Fuel:Return the Vehicle with the same fuel level as collected. Use only the specified fuel (e.g., Shell Ron 98). Mis-fueling costs are your liability.
  • • Fines & ERP:You are responsible for all parking, traffic, and ERP (Electronic Road Pricing) charges. You must ensure your cash card has sufficient value.
  • • Prohibition on Modification:You must not modify, alter, tint windows, or attach decals to the Vehicle without written consent.

09Prohibited Uses

The Vehicle shall NOT be used:

  • To carry persons or property for hire (e.g., private hire/Grab) or for driving tuition.
  • To propel or tow any vehicle, trailer, or other object.
  • In any race, test, contest, or off-road driving.
  • For any illegal purpose or to carry illicit drugs.
  • By anyone under the influence of alcohol or drugs.
  • Geographical Restriction: To drive out of Singapore (e.g., into Malaysia) without prior written notification and payment of the requisite surcharge. Driving out of Singapore without authorization will result in the forfeiture of the security deposit.

10Accidents, Damages & Theft

In the event of an accident or damage:

  • • Reporting:You must report any accident to the Company within 24 hours.
  • • No Unauthorized Repairs:Do not attempt to repair the car yourself. A minimum penalty (at prevailing rates) plus the cost of proper rectification will be charged for unauthorized repairs. All repairs must be carried out by an Ace Drive authorized workshop.
  • • Procedure:Do not admit liability. Obtain details of third parties. Lodge a police report if required by law (e.g., injury or government property damage).
  • • Deposit Withholding:Should you meet with an accident, the deposit will be withheld until the case is fully settled and closed.
  • • Excess Payment:The insurance excess / deductible have to be paid on the accident reporting day and will be refunded if the insurance claim is successful.

11Insurance and Liability

Liability Insurance: Authorized Drivers are covered by a Motor Vehicle Liability policy for third-party liability and property damage up to statutory limits.

Exclusions: Coverage does not apply if the Vehicle was used in violation of these Terms (e.g., unauthorized driver, drunk driving). In such cases, your liability is unlimited.

Collision Damage Reducer (CDR): CDR is not insurance. If accepted and paid for, it reduces your financial liability (Excess) for damage to the Vehicle and does not cover self inflicted damages.

Super Collision Damage Waiver (SCDW): SCDW is not insurance. If accepted and paid for, it further reduces the financial liability (Excess) for damage to the vehicle and does not cover self inflicted damages.

Indemnity: You agree to indemnify and hold Ace Drive Pte Ltd harmless from all claims, costs, and liabilities (including legal fees) arising from your use of the Vehicle or breach of these Terms.

12Maintenance and Tracking

Maintenance: The Company provides maintenance. You must not permit any third party to repair the vehicle without consent.

Telematics/Tracking: The Vehicle may be fitted with a tracking device and is for the purpose of monitor location, mileage, speed, and trip history. You consent to this data collection. We reserve the right to apply penalties based on tracking data indicating prohibited travel (e.g., entering Malaysia without approval) or unsafe driving (e.g., speeding).

13Termination and Repossession

Termination: We may terminate this Agreement immediately if you breach these Terms, failure to make payment on time, or if the Vehicle is seized/impounded.

Repossession: The Company may repossess the Vehicle without demand at your expense if it is illegally parked, used in violation of the law, abandoned, or if payments are in default.

Early Termination: If you return the vehicle earlier than the agreed date, you may be subject to early termination fees as per the prevailing rates defined in your Rental Agreement.

14Additional Charges

You are liable for the following charges (subject to prevailing GST):

  • Mileage: Excess mileage charged at the prevailing rate per km.
  • Late Return: Charged at a percentage of the daily rental rate per hour.
  • Fuel Surcharge: Charged per liter for shortages, plus an administrative refueling fee.
  • Cleaning: Professional detailing fees apply for smoking, eating, drinking, or pest control issues inside the Vehicle.
  • Admin Fees: Administrative fees apply to the processing of fines, tolls, and damage claims.
  • Recovery: Service fees apply for non-mechanical breakdown recovery (e.g., flat battery, puncture).
  • Collection Expenses: You are liable for all legal and administrative costs incurred in collecting overdue payments or repossessing the Vehicle.

15Immobilization

In the event of non-payment of dues or violation of geographical restrictions, the Company reserves the right to remotely immobilize the Vehicle. An administrative fee will be charged for re-mobilization. The Company is not liable for any personal belongings or delays resulting from immobilization.

16Disclaimer of Warranties & Limitation of Liability

The Services are provided "as is." The Company makes no express or implied warranty as to the Vehicle's fitness for any particular purpose.

Limitation: To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, or consequential damages (including loss of profit or data) arising from the use of the Vehicle or Service.

17Privacy and Data Protection

By using our Services, you consent to the collection, use, and disclosure of your personal data in accordance with the Personal Data Protection Act (PDPA) of Singapore.

Third Parties: You agree that we may disclose your data to third-party partners (including verification agencies, insurers, and debt collection agencies) for the purposes of:

  • Verifying identity and creditworthiness.
  • Processing insurance claims.
  • Recovering outstanding debts.
  • Complying with legal obligations (e.g., Traffic Police).

18Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Singapore.

Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the Singapore courts.

19General

  • Severability: If any provision of these Terms is found to be invalid, the remaining provisions shall remain in full force.
  • No Waiver: Failure by the Company to enforce any right does not constitute a waiver of that right.
  • Assignment: You may not assign your rights under this Agreement without our written consent.
